Charitable Grantor Lead Trusts

If a lead trust is created with a reversion to the grantor of trust assets that exceed 5% of value, the lead trust will be a grantor trust. All income and gains will flow through and be taxable to the grantor on their personal tax return.

It works as follows:
  1. Reversion to Grantor: If a lead trust is created with a reversion to the grantor of trust assets that exceed 5% of value, the lead trust will be a grantor trust.
  2. Income Tax Deduction: The grantor lead trust qualifies for an income tax deduction.
  3. Trust Investments: A grantor lead trust enables the donor to report an income tax deduction in the year the trust is funded.
  4. Donor Profile: The grantor lead trust is typically funded by a donor in a high income tax bracket.
The benefits of using Grantor Lead Trust donation:
  1. This charitable trust provides income to the Gene Therapy Institute for Hispanic Medical Research for specific number of years but not more than 20 years. The trust must be either a unitrust or an annuity trust.
  2. The grantor can decide on the tax deductible amount donated to The Gene Therapy Institute directly if the grantor needs to counteract capital gains. It can also be adjusted to pay for the taxes on profits.
  3. There are no estate or donation tax consequences for a grantor lead trust, but a charitable income tax deduction is available to the grantor.
  4. As grantor, you could accelerate, in the first year, the profit of the income payments to the Gene Therapy Institute in the form of charitable income tax deduction, subject to the restrictions on deductibility.

For instance, if you donate $2,000,000 to a grantor annuity trust paying 6% for a period of 20 years, you may possibly get a charitable income tax deduction of $1,323,824.36. Each year, the grantor annuity trust will grant an income of $120,000 to The Gene Therapy Institute.
